Wage and Hour Laws

The Fair Labor Standards Act establishes minimum wage, overtime, and record-keeping requirements for most public and private employers. This program is only for employees not for contractors, because the courts generally conduct a specific inquire this issue and consider five factors to determine whether an independent contractor is in reality an employee.
Who sets the worker's hour, provides tools and working materials, uniform, transportation, expenses, etc.
